What Determines Patent Invalidation: A Look at Germany
A free public seminar in Melbourne proudly presented by IPRIA in association with the Institute of Patent and Trade Mark Attorneys of Australia in Melbourne and Sydney.
Timo Fischer presents empirical analysis on the total population of 563 patents that were the subject of invalidation proceedings in the German patent court (Bundespatentgericht) between 1985 and 1999. He finds that a patent is less likely to be invalidated the greater is its inventive step and the more likely it was to have survived an opposition proceedings. He also finds that small firms have higher incentives to defend theirpatents than large firms.
