Overview

 

A free public seminar in Melbourne, presented by the Intellectual Property Research Institute (IPRIA) in association with the Institute of Patent and Trade Mark Attorneys of Australia (IPTA) and IP Australia.

To date, the patent examination procedures of the patent offices have been a “black box” to those who do not engage with them on a daily basis. Our work opens up this box by comparing the claims of patents granted by the USPTO, the EPO and IP Australia.

As the applications to the three offices were identical, our research demonstrates the extent to which ostensibly similar tests for patentability applied by the three offices produce notably different results. Despite the TRIPS Agreement underpinning the legal tests, we find that any goal of harmonisation of examination outcomes is still a significant distance away.

 

Presenters

Dr Chris Dent is a Senior Research Fellow with IPRIA at the Melbourne Law School. The focus of his work is on applying different analytical approaches to the operation of patent system – ranging from empirical examinations of the use of the system to the application of historical and critical methodologies to the operation of the system within the broader community.

Professor Andrew Christie was appointed the foundation Chair of Intellectual Property at the Melbourne Law School in 2002.

From March 2002 to June 2008 he was the founding Director of the Intellectual Property Research Institute of Australia (IPRIA), a national centre for multi-disciplinary research on the law, economics and management of intellectual property.

Andrew is an active adviser to governments and inter-governmental organizations on intellectual property law and policy.  He has been identified by the international magazine Managing IP as one of the world’s 50 most influential people in intellectual property.
